Homeownership Is a Human Right

Owning a home is more than a financial milestone. It’s a symbol of stability, opportunity, and belonging. But for decades, unfair lending practices kept millions of Americans from that dream. That’s why today, Fair Housing and Equal Credit laws exist. This is to protect your path to homeownership from bias or discrimination.

 

The Fair Housing Act;  What It Covers

Passed in 1968, the Fair Housing Act made it illegal to discriminate based on: Race, Color, Religion, Sex, Disability, Familial status, and National origin. Recent policy updates now extend protection to sexual orientation and gender identity, reflecting our nation’s growing inclusivity.

The Act applies to every part of the home buying process from viewing listings, to applying for a loan, to closing day.

 

The Equal Credit Opportunity Act (ECOA)

The ECOA ensures that lenders evaluate all applicants by the same financial standards. They cannot deny or alter loan terms based on personal characteristics such as age, gender, marital status, or source of income (like Social Security or child support).

Lenders must also notify applicants of approval or denial within 30 days, provide a reason for any denial, and allow consumers to review and correct errors in their credit report. These rules protect buyers from arbitrary or discriminatory lending decisions.

Redlining and Modern Discrimination

Although the infamous “redlining” maps are gone, their effects remain. Predatory loans and biased appraisals often target the same neighborhoods that were once excluded decades ago.

That’s why awareness matters and why agents, lenders, and appraisers must constantly evaluate their practices for fairness and integrity.

The REALTOR® Commitment to Ethics

The NAR Code of Ethics goes beyond the law. Under Article 10, REALTORS® pledge to provide equal service to all people, regardless of identity, background, or beliefs.


They also commit to avoiding language or conduct that could be seen as discriminatory, promoting inclusion and transparency, and reporting unethical practices when witnessed. When you work with a REALTOR® who values ethics, you’re working with a professional who protects your trust and your rights.

Buyers can protect themselves by knowing their rights before meeting with lenders, keeping records of all communications and offers, comparing multiple lenders to spot inconsistencies, and speaking up if something doesn’t feel right by contacting HUD or a Fair Housing agency.
